Welcome to SecretRoom Escape. By accessing our website, booking our quest rooms, or participating in any of our escape room experiences, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

These terms apply to all visitors, users, customers, and others who access or use our services. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates on our website. It is your responsibility to check this page periodically for changes.

2. Booking and Reservations

2.1 Booking Process

All bookings must be made through our official website, phone, or email. A booking is confirmed only when you receive a confirmation email from SecretRoom Escape. Please ensure all contact information provided is accurate and up-to-date.

2.2 Payment Terms

Payment is required at the time of booking to secure your reservation. We accept major credit cards, debit cards, and other payment methods as indicated on our website. All prices are in Australian Dollars (AUD) and include applicable taxes unless otherwise stated.

2.3 Cancellation Policy

• Cancellations made more than 48 hours before the scheduled time will receive a full refund
• Cancellations made between 24-48 hours before the scheduled time will receive a 50% refund
• Cancellations made less than 24 hours before the scheduled time are non-refundable
• No-shows will not receive any refund
• Rescheduling is allowed up to 24 hours before your booking without penalty

3. Participant Requirements

3.1 Age Requirements

Participants under the age of 16 must be accompanied by an adult (18+) at all times during the experience. Some rooms may have higher age restrictions, which will be clearly indicated at the time of booking. Adult supervision is required for all minors.

3.2 Health and Safety

Participants must be in reasonable physical and mental health to participate. Our quest rooms may involve:

• Physical activity including bending, reaching, and moving around enclosed spaces
• Dark environments with limited lighting and occasional strobe effects
• Loud sounds and sudden audio effects
• Enclosed spaces that may not be suitable for those with claustrophobia

Pregnant women, individuals with heart conditions, epilepsy, or other serious health conditions should consult with their physician before participating. Please inform our staff of any health concerns prior to your experience.

3.3 Conduct Requirements

All participants must:

• Follow all instructions provided by game masters and staff
• Treat all props, equipment, and facilities with respect
• Refrain from using excessive force on any game elements
• Not consume alcohol or illegal substances before or during the experience
• Respect other participants and maintain appropriate behavior

4. Liability and Assumption of Risk

4.1 Assumption of Risk

By participating in our escape room experiences, you acknowledge that there are inherent risks associated with the activities. You voluntarily assume all risks related to participation, including but not limited to physical injury, property damage, or emotional distress.

4.2 Release of Liability

To the fullest extent permitted by law, SecretRoom Escape, its owners, employees, and affiliates shall not be liable for any injuries, losses, damages, or claims arising from your participation in our activities. This includes injuries resulting from your own actions, the actions of other participants, or the condition of our facilities.

4.3 Personal Property

SecretRoom Escape is not responsible for any lost, stolen, or damaged personal property. We recommend leaving valuable items secured in your vehicle or at home. Lockers are available for storing personal belongings during your experience.

5. Privacy and Data Protection

Your privacy is important to us. We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. This may include:

• Contact information for booking and communication purposes
• Payment information for processing transactions
• Photos or videos taken during your experience (with your consent) for marketing purposes

6. Intellectual Property

All content on the SecretRoom Escape website and within our quest rooms, including but not limited to text, graphics, logos, images, puzzle designs, storylines, and software, is the property of SecretRoom Escape and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of our content without our express written permission. This includes sharing puzzle solutions, room designs, or proprietary game mechanics publicly or online.

7. Photography and Video Recording

For the enjoyment and fairness of all participants, photography and video recording inside quest rooms is strictly prohibited unless explicitly permitted by staff. We may take photos or videos of your group for promotional purposes. If you do not wish to be photographed or filmed, please inform our staff before your experience begins.

By participating, you grant SecretRoom Escape the right to use any photographs or videos taken during your visit for marketing, advertising, and promotional purposes without compensation.

8. Right to Refuse Service

SecretRoom Escape reserves the right to refuse service to anyone for any reason at any time. This includes, but is not limited to, situations where:

• A participant appears to be intoxicated or under the influence of substances
• A participant displays aggressive, inappropriate, or disruptive behavior
• A participant fails to follow safety instructions or staff directions
• A participant poses a risk to themselves, other participants, or our property
• A participant violates any of these Terms of Service

In such cases, no refund will be provided.

9. Force Majeure

SecretRoom Escape shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government restrictions, power failures, or other emergencies.

In such events, we will make reasonable efforts to reschedule your booking or provide a full refund at our discretion.

10. Modifications to Services

We reserve the right to modify, suspend, or discontinue any aspect of our services, including quest rooms, pricing, or operating hours, at any time without prior notice. We will make reasonable efforts to notify confirmed bookings of any significant changes that may affect their scheduled experience.

11. Dispute Resolution

Any disputes arising from these Terms of Service or your use of our services shall be governed by the laws of Queensland, Australia. Both parties agree to first attempt to resolve any disputes through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Brisbane, Queensland.

12. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid under applicable law, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
